Privacy Policy

I provide a civil and commercial mediation service focussing on contentious trust and probate law.  In the course of providing it I will receive, use and hold securely personal data about the parties. I am required to provide you with information about how I will use the data and your rights in respect of the data.

The Data Controller

I am “the Data Controller” in respect of personal data that is supplied to me for a mediation. I can be contacted by post at Lime Tree Cottage, Beechwood Road, Bartley, SO40 2LP (“my postal address”) or by email at [email protected] (“my email address”).

The Legal Basis for the Processing

The information that I collect will be used for the following purposes:

1. Purpose of the Processing

In order to provide a mediation service which will be outlined in a mediation agreement.

I will keep a copy of the mediation records and the information that has been supplied in connection with the mediation for a period of 6 years after the processing

2. The Legal Basis for the Processing

The information will be collected and used because it is necessary to perform a contract for the provision of mediation services.

The retention of the information is in my legitimate interests because I may need to refer to it if any question should arise about the conduct of the mediation.

How I use Cookies

It is possible that I may gather information regarding your computer for my service. This collection of data is used for statistical analysis about my website for use by me. 

Cookies may be used to gather this general internet data. When used, cookies are downloaded to your computer without prompting. The cookie file is stored on your hard drive, where files are transferred to. This information helps me improve my site and services to you.

All computers can block cookies by activating proper browser settings. There is a place to enable you to decline cookies under the options menu. Please note if you decline cookies you may experience limited access to certain areas of our site.

Recipients of Your Personal Data

I may provide your personal data to the other party to the mediation and their legal advisers but I will only do so with your consent

If You Fail to Provide Personal Data

If you fail to provide the information that I have requested, I will be unable to proceed with the mediation

Consent

If we ask for your consent to use your personal data you may withdraw your consent at any time by contacting me at my postal address or my email address.

The withdrawal of consent does not affect the processing of any data that has already taken place.

How Long Will Your Data be Kept?

I will keep the records of the mediation including your personal data for a period of 6 years, at which point they will be destroyed.

Your Rights in Relation to Your Personal Data

Under certain circumstances, by law you have the right to:

  • Request access to your personal information (commonly known as a "data subject access request"). This enables you to receive a copy of the personal information I hold about you and to check that I am processing it lawfully
  • Request correction of the personal information that I hold about you. This enables you to have any incomplete or inaccurate information I hold about you corrected.
  • Request erasure of your personal information. This enables you to ask me to delete or remove personal information where there is no good reason for me continuing to process it. You also have the right to ask me to delete or remove your personal information where you have exercised your right to object to processing (see below).
  • Object to processing of your personal information where I am relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where I am processing your personal information for direct marketing purposes.
  • Request the restriction of processing of your personal information. This enables you to ask me to suspend the processing of personal information about you, for example if you want me to establish its accuracy or the reason for processing it.
  • Request the transfer of your personal information to another party.

If you want to review, verify, correct or request erasure of your personal information, object to the processing of your personal data, or request that I transfer a copy of your personal information to another party, please contact me at my postal address or my email address.

If you are dis-satisfied with the way in which I have dealt with your personal data, you have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues.
